TERMS OF SERVICE

1. Introduction

These Terms of Service govern the use of the Sting Naturals website and the purchase of products through the website.

By using this website, placing an order, or purchasing products from Sting Naturals, you agree to be bound by these Terms of Service.

If you do not agree with these Terms, you should not use the website or place an order.

2. Products and Website Information

Sting Naturals sells natural and related products through the website.

We make reasonable efforts to ensure that product descriptions, photographs, prices, stock information and other website content are accurate. However:

• Product colours and appearances may vary slightly from photographs.
• Product packaging, labels and presentation may change from time to time.
• Product availability may change without notice.
• We reserve the right to correct errors or omissions on the website.
• We reserve the right to update product information, descriptions and prices without prior notice.

Any changes will not affect an order that has already been accepted and paid for, except where permitted or required by law.

3. Eligibility to Purchase

The website is available to all customers. There is no general age restriction for purchasing products from Sting Naturals.

Customers must provide accurate and complete information when placing an order, including their name, delivery address, telephone number and email address.

Sting Naturals is not responsible for delays or failed deliveries caused by incorrect, incomplete or outdated information supplied by the customer.

4. Orders

Customers may place orders directly through the website without creating an account.

An order is only considered accepted once Sting Naturals has confirmed the order and, where applicable, payment has been successfully received.

Sting Naturals reserves the right to refuse, cancel or limit an order where:

• A product is unavailable.
• There is an obvious pricing or product-description error.
• Payment has not been received or cannot be verified.
• The customer has supplied incorrect information.
• The order appears fraudulent or unlawful.
• The order exceeds reasonable quantity limits.
• The order cannot reasonably be fulfilled.

If Sting Naturals cancels an order after payment has been received, the customer will receive a refund of the amount paid, subject to applicable law.

5. Prices and Payment

All prices displayed on the website are in South African Rand.

Sting Naturals is not registered for VAT. Website prices are therefore not VAT-inclusive prices and no VAT is charged unless Sting Naturals becomes VAT registered in the future.

Payment methods may include:

• PayFast;
• Electronic funds transfer, or EFT; and
• Cash on collection.

EFT orders will only be processed once the payment has cleared into Sting Naturals’ bank account.

Cash payment is only available for orders collected directly from Sting Naturals. Cash on delivery is not available for courier deliveries.

Sting Naturals may cancel an order if payment is not received within the required period or if payment cannot be verified.

6. Order Cancellation Before Dispatch

A customer may request cancellation of an order before it has been dispatched, provided that the order has not already been prepared, processed or handed to the courier.

Once an order has been dispatched or handed to the courier, the customer must follow the applicable return or cancellation process described in these Terms.

7. Delivery

Sting Naturals delivers within South Africa only.

Courier deliveries are handled by The Courier Guy or another suitable delivery provider selected by Sting Naturals.

The estimated delivery timeframe is:

4–14 business days

Delivery timeframes exclude weekends and public holidays and are estimates only. Delays may occur because of courier operations, weather, public holidays, remote delivery locations, incorrect customer information or circumstances outside Sting Naturals’ reasonable control.

Delivery fees are currently:

• PUDO locker delivery: R70 for orders under R1,000;
• Door delivery: R150 for orders under R1,000; and
• Free delivery: Orders over R1,000.

Sting Naturals reserves the right to change delivery fees, delivery methods and free-delivery thresholds. The delivery fee applicable to an order will be displayed before the customer completes the purchase.

The customer is responsible for ensuring that someone is available to receive the parcel at the supplied delivery address.

Sting Naturals is not responsible for delivery delays or failed deliveries caused by:

• An incorrect or incomplete delivery address;
• The recipient being unavailable;
• A refusal to accept the parcel;
• Failure to respond to courier communication;
• Incorrect contact details;
• A courier delay or operational issue; or
• Circumstances outside Sting Naturals’ reasonable control.

Where a parcel is lost, damaged or delayed during delivery, the customer must contact Sting Naturals so that the matter can be investigated with the courier.

8. Collection Orders

Customers may collect orders directly from Sting Naturals at:

Collection is available during the following business hours:

Collection is not available on public holidays unless separately arranged.

Customers should contact Sting Naturals in advance to arrange collection and confirm that the order is ready.

9. Change-of-Mind Returns

A customer may request a change-of-mind return within 30 days of receiving the product, provided that:

• The product is unopened;
• The product is unused;
• The product is in its original condition and packaging; and
• The customer contacts Sting Naturals before returning the product.

Customers must first contact Sting Naturals at info@stingnaturals.co.za for return instructions.

The customer is responsible for the cost of returning a product under the change-of-mind return policy.

Once the returned product has been received and inspected, Sting Naturals will process the refund within 5–10 business days, where applicable.

Refunds will be made using the same payment method originally used, where possible.

10. Damaged Products

If a product arrives damaged, the customer must contact Sting Naturals within 7 days of delivery.

The customer may be required to provide:

• The order number;
• A description of the damage; and
• Photographs of the product and packaging.

Where the product is confirmed to have been damaged before or during delivery, Sting Naturals will arrange a replacement at no additional cost to the customer, subject to applicable law and stock availability.

If a replacement is not reasonably possible, Sting Naturals will provide an appropriate remedy as required by law.

11. Incorrect Products

If the wrong product is supplied, the customer must contact Sting Naturals within 7 days of delivery.

Where Sting Naturals supplied the incorrect product, Sting Naturals will arrange a replacement at no additional cost to the customer, including reasonable return-delivery costs.

The customer must not return the product without first contacting Sting Naturals for return instructions.

12. Consumer Rights

Nothing in these Terms is intended to limit, exclude or waive any right that a customer may have under applicable South African law, including the Consumer Protection Act 68 of 2008 and the Electronic Communications and Transactions Act 25 of 2002.

Where a provision of these Terms conflicts with a mandatory legal requirement, the applicable law will prevail.

Customers may have additional rights relating to defective, unsafe, unsuitable, incorrectly described or incorrectly supplied goods.

13. Product Use and Customer Responsibility

Customers are responsible for reading and following all product instructions, warnings, labels and usage directions.

Sting Naturals is not responsible for harm, loss or damage caused by:

• Misuse of a product;
• Failure to follow product instructions;
• Improper storage;
• Use of a product for an unintended purpose;
• Failure to disclose relevant allergies or sensitivities; or
• An allergic reaction or sensitivity that could not reasonably have been prevented.

Customers should stop using a product and seek appropriate professional advice if they experience an adverse reaction.

Nothing in this section excludes liability that cannot lawfully be excluded.

14. Promotions and Discounts

Sting Naturals may offer discounts, promotions or special offers from time to time.

Each promotion may have its own terms and conditions, including:

• Start and end dates;
• Minimum order values;
• Product exclusions;
• Quantity limits;
• Customer eligibility requirements; and
• Whether the promotion may be used with other discounts.

Promotion terms will apply in addition to these Terms of Service.

Sting Naturals reserves the right to withdraw or amend a promotion where permitted by law.

15. Bulk Orders

The website is primarily intended for individual customer purchases.

Customers interested in bulk orders may contact Sting Naturals directly at info@stingnaturals.co.za.

Bulk orders may be subject to separate:

• Pricing;
• Payment terms;
• Minimum order quantities;
• Delivery arrangements; and
• Collection arrangements.

Any separate agreement for a bulk order must be confirmed in writing by Sting Naturals.

16. Future Subscriptions

Sting Naturals may introduce subscription products or recurring deliveries in the future.

If subscriptions are introduced, customers will be informed of the applicable subscription terms before subscribing.

Subscription customers will be able to cancel, pause or change their subscription before the next scheduled delivery, subject to the applicable subscription terms and any reasonable processing deadlines.

17. Product Reviews and Ratings

Customers may be permitted to submit product reviews, ratings, photographs or other feedback.

By submitting content, the customer confirms that:

• The content is truthful and based on their genuine experience;
• The content does not infringe another person’s rights;
• The content is not unlawful, abusive, misleading, defamatory or offensive; and
• The customer has the right to submit the content.

Sting Naturals may remove or refuse to publish content that is unlawful, misleading, fraudulent, irrelevant, abusive or inconsistent with these Terms.

18. Website Content and Intellectual Property

All website content, including photographs, product descriptions, logos, branding, graphics, text, designs and other materials, is owned by or licensed to Sting Naturals unless otherwise stated.

Customers may use the website for personal and lawful purposes only.

No website content may be copied, reproduced, modified, distributed, sold or used commercially without the prior written permission of Sting Naturals, except where permitted by law.

19. Personal Information and Privacy

Sting Naturals may collect and process customer information necessary to:

• Process and fulfil orders;
• Arrange delivery or collection;
• Communicate with customers about orders;
• Process payments;
• Respond to enquiries;
• Handle returns and complaints; and
• Comply with legal obligations.

Information collected may include the customer’s name, delivery address, telephone number and email address.

Sting Naturals will use customer information for marketing purposes only where the customer has opted in or otherwise provided the required consent.

Where the customer has not consented to marketing, their information will be used only for the relevant order, customer service or lawful business purposes.

Sting Naturals will process personal information in accordance with applicable privacy laws, including the Protection of Personal Information Act 4 of 2013, commonly known as POPIA. POPIA establishes requirements for the lawful processing and protection of personal information by private and public bodies.

A separate Privacy Policy should be made available on the website.

20. Website Availability and Security

Sting Naturals does not guarantee that the website will always be available, uninterrupted, error-free or free from viruses or other harmful components.

The website may occasionally be unavailable because of maintenance, updates, technical issues or circumstances outside Sting Naturals’ control.

Customers must not:

• Attempt to gain unauthorised access to the website;
• Interfere with website security;
• Introduce malicious code;
• Use the website for unlawful purposes; or
• Attempt to disrupt the website or its services.

21. Limitation of Liability

To the extent permitted by law, Sting Naturals will not be liable for indirect, incidental, special or consequential loss arising from the use of the website or the purchase or use of products.

This includes loss caused by:

• Courier delays;
• Incorrect delivery information supplied by the customer;
• Failure to follow product instructions;
• Misuse of products;
• Temporary website unavailability; or
• Events outside Sting Naturals’ reasonable control.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability for rights protected under applicable consumer-protection legislation.

22. Events Outside Our Control

Sting Naturals will not be responsible for failure or delay in performing its obligations where the failure or delay is caused by circumstances beyond its reasonable control.

These circumstances may include:

• Natural disasters;
• Severe weather;
• Fire;
• Flooding;
• Power failures;
• Internet or telecommunications failures;
• Courier disruptions;
• Strikes;
• Government restrictions;
• Civil unrest; or
• Other unforeseen events.

Sting Naturals will take reasonable steps to minimise the effect of such events.

23. Changes to These Terms

Sting Naturals may update these Terms of Service from time to time.

The updated version will be published on the website with a revised “Last updated” date.

Where a significant change materially affects customers, Sting Naturals will provide notice by an appropriate method where reasonably practicable.

The Terms applicable to an order will generally be the Terms in effect when the order was placed, unless a change is required by law.

24. Governing Law and Disputes

These Terms are governed by the laws of the Republic of South Africa.

Any dispute arising from the use of the website or the purchase of products will be dealt with through the appropriate South African legal processes.

Customers are encouraged to contact Sting Naturals first so that complaints or disputes can be resolved informally where possible.

26. Entire Agreement

These Terms, together with any applicable order information, promotion terms, Privacy Policy and other policies published on the website, form the agreement between Sting Naturals and the customer regarding the use of the website and purchase of products.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

27. Acceptance

By using the website or placing an order, the customer confirms that they have read, understood and agreed to these Terms of Service.
